Premises Liability Case Ends in $445,000 Total Compensation
Newman Injury Law handled premises liability litigation involving a male waiter injured during the course of his employment when a piece of outdoor furniture fell from a 5-story roof deck that was under construction. The furniture fell to the ground and ricocheted up into the waiter's back, causing him to suffer a thoracic compression fracture. The plaintiff was treated conservatively with bracing, physical therapy and epidural injections and made a full recovery. The matter proceeded to trial as the various property owners and furniture owners did not accept fault. On the eve of the trial, the furniture owner paid $250,000.00 to be released from the litigation. The case was then tried before a jury to reach a verdict against the non-settling parties. The jury rendered a $325,000.00 verdict. Due to the effect of the joint tortfeasor release, the plaintiff ended up being paid $445,000.00, which was $120,000.00 more than the actual verdict.
